死刑執行を死刑囚に当日告知する運用は憲法に違反し非人道的だとして、死刑囚２人が４日、国に精神的苦痛への慰謝料計約２千万円の支払いなどを求め、大阪地裁に提訴した。

弁護団によると、死刑を当日告知する運用をめぐる訴訟の提起は初めて。 訴状などによると、死刑の執行は法務大臣による命令から５日以内の実施が法律で定められているが、告知の時期に関する規定はない。

現在は死刑囚本人に執行の１～２時間前に伝える「即日告知・即日執行」の手法で運用されている。 原告側はこうした運用について、「法律による適正な手続きを経た刑罰」を定めた憲法の規定に違反していると指摘。

刑事訴訟法は死刑の執行停止や不服申し立ての権利を保障しているが、現在の運用では死刑囚が弁護人に連絡する時間すらないと訴えている。

編集後記

死刑囚である当事者たちが国を訴えたのはびっくりですが、執行を当日告知する方法には議論の余地がありますね。

以前、ある手記で「毎朝、執行を突然告知される恐怖に怯えながら生活していた」という記述を読んだのを思い出しました。

死刑制度が先進国で廃止される傾向にある中、その是非を改めて考える良いきっかけになりました。
